Section 30
A brief list should be prepared by openly asking for a letter of intent
(1) If a consulting service of more than the specified amount is to be purchased, the public body shall give a period of at least fifteen days to collect the related letter of intent from the person, firm, institution or company willing to provide such consulting service. The information should be published in the newspaper in accordance with the specified matters.
(2) The notice according to sub-section (1) can be placed on the web site of the relevant ministry of the public body or the public procurement monitoring office.
(3) An international letter of intent should be requested in the following cases:-
(a) In case of purchase of consulting services in excess of the specified amount,
(b) If the consulting services required by the public body cannot be obtained from more than one consultant within the state of Nepal at a competitive price,
(c) In the event that a proposal is requested at the national level for consulting services and the service is required to be obtained from a foreign consultant without receiving any proposal, or
(d) If it is necessary to receive services from a consultant by requesting an international level letter of intent to be received from foreign aid sources in accordance with the agreement with the donor.
(4) When requesting a letter of intent as per sub-section (3), notice shall be published in English language.
(5) After evaluating the qualifications, experience and capacity of the applicants who have come under subsection (1) or (3), the public body shall select and prepare a short list of generally three to six applicants who can provide such consulting services.
(6) In case of purchase of consulting services for less than the specified amount, the public body may prepare a list of persons, firms, organizations or companies who can provide such consulting services after completing the prescribed process and from among the persons, firms, organizations or companies included in the list, the prescribed process The proposal should be completed and requested according to section 31.
(2) The notice according to sub-section (1) can be placed on the web site of the relevant ministry of the public body or the public procurement monitoring office.
(3) An international letter of intent should be requested in the following cases:-
(a) In case of purchase of consulting services in excess of the specified amount,
(b) If the consulting services required by the public body cannot be obtained from more than one consultant within the state of Nepal at a competitive price,
(c) In the event that a proposal is requested at the national level for consulting services and the service is required to be obtained from a foreign consultant without receiving any proposal, or
(d) If it is necessary to receive services from a consultant by requesting an international level letter of intent to be received from foreign aid sources in accordance with the agreement with the donor.
(4) When requesting a letter of intent as per sub-section (3), notice shall be published in English language.
